Introduction, Contracting Parties, and Scope

These Terms form an agreement between you and the operator of the service under the name "Pawjai" ("Pawjai," "we," or the "Service Provider"). Those expressions include the person or entity operating Pawjai from time to time and a lawful transferee, successor, or entity assuming operation after notice to users. These Terms cover Pawjai websites, applications, features, APIs, content, subscriptions, and linked services. Please review these Terms, the Privacy Policy, and any optional consent notice before accepting. If you do not agree, do not create an account or use service features requiring acceptance. If the business or operation is transferred, Pawjai will give at least thirty (30) days advance notice where legally and practically possible. The transferee will assume the relevant rights and obligations. A user who does not wish to continue may cancel during the notice period, and personal-data rights remain governed by law and the Privacy Policy.

1. Acceptance and Changes to These Terms

You agree to these Terms after having an opportunity to review the relevant documents and taking the electronic acceptance action provided by Pawjai, such as checking the required acceptance box and selecting the continue button. That electronic record may be retained as evidence of your intent under applicable electronic-transactions law. The Privacy Policy explains Pawjai's processing of personal data and forms part of the service framework. Marketing consent is voluntary and separate from acceptance of these Terms. Refusing or withdrawing marketing consent will not prevent access to the core service. Pawjai may update these Terms to reflect changes to the service, law, security, or operations. Pawjai will provide reasonable advance notice of material changes through the service, website, email, or another appropriate channel. Where a change materially affects user rights or applicable law requires renewed consent, Pawjai will request a new acceptance or consent. Continued use after a non-consent-based change takes effect may constitute acceptance of that change, without limiting mandatory consumer or data-protection rights.

2. Users of All Ages, Minors, and Legal Capacity

Pawjai is designed so people of all ages may benefit from pet-care information. Creating an account, accepting these Terms, giving personal-data consent, or purchasing a service must nevertheless be performed by a person with legal capacity or with the involvement and authorization of a parent or legal representative where required by law. If a user is a minor or otherwise has limited legal capacity, the legal representative must review and accept these Terms, supervise use, and be responsible for payments or acts for which representative authorization is legally required. Consent under Thailand's Personal Data Protection Act will be handled in accordance with the rules for minors in Section 20, including parental consent where the user is under ten years old. Users and legal representatives represent that information supplied is reasonably accurate, that they are not impersonating another person, and that they will notify Pawjai if an account or consent was created without authority. Pawjai may pause legally consequential transactions, limit features, or request proportionate information where reasonably necessary to protect a minor, a user, or the service.

3. Registration and Account Security

You must protect your devices, sign-in methods, and account credentials, must not disclose passwords or verification codes to unauthorized persons, and should promptly notify support@pawjai.co if you know or reasonably suspect that your account has been used without authorization. You are responsible for activity resulting from access you knowingly permit, except to the extent that loss is caused by an act or omission for which Pawjai is legally responsible. Pawjai will maintain technical and organizational safeguards appropriate to the nature, risk, and scale of its operations. Internet and electronic systems cannot, however, be guaranteed to be completely secure or continuously available. Pawjai may terminate sessions, suspend access, alter authentication procedures, or take emergency protective measures when reasonably necessary for security, and will notify affected users when doing so is practicable and would not increase risk.

4. Nature of the Service, AI Limitations, and Veterinary Warning

Pawjai is a pet-care information and management tool that includes functions supported by artificial intelligence. Content, recommendations, assessments, and AI outputs are not an examination, diagnosis, treatment, prescription, or professional veterinary service and do not create a veterinarian-client-patient relationship. AI output may be inaccurate, incomplete, outdated, or unsuitable for an individual animal. You must verify important information, exercise judgment, and consult a licensed veterinarian before making decisions about diagnosis, medication, diet changes, treatment, or matters affecting life or health. Pawjai is not an emergency channel. If an animal has severe symptoms, difficulty breathing, loss of consciousness, seizures, major bleeding, suspected poisoning, or another urgent condition, contact a veterinary hospital or emergency service immediately. You are responsible for providing accurate information and not omitting material facts. To the extent permitted by law, Pawjai is not responsible for harm caused by inaccurate user input, misuse of the service, disregard of a clear warning, or substitution of general content for professional veterinary diagnosis. Nothing in this section excludes liability that applicable law does not permit Pawjai to exclude.

5. Intellectual Property and User Content

The software, designs, marks, Pawjai-created content, models, processes, and service components are owned by Pawjai or its licensors. You receive a personal, limited, non-exclusive, revocable, and non-transferable right to use the service in accordance with these Terms. You may not copy, modify, distribute, sell, sublicense, reverse engineer, scrape, or use the service to build a competing product unless applicable law expressly permits it or Pawjai gives written permission. You retain rights in pet information, text, photographs, and other content you submit and represent that you have authority to provide it for processing. You grant Pawjai a non-exclusive license, limited to what is reasonably necessary, to host, back up, process, format, display, and transmit that content to provide, secure, troubleshoot, and improve the service in accordance with the Privacy Policy. This license ends when the content is deleted under the Policy, except for genuinely anonymized information or records that Pawjai must lawfully retain.

6. Acceptable Use

The User agrees, represents, and warrants that they shall not engage in or permit any of the following: (a) Use the services in any manner that violates applicable laws, regulations, court orders, public morality, or public order. (b) Attempt to access, probe, or test the vulnerabilities of the Service Provider's systems, servers, networks, databases, or infrastructure without prior express written authorization. (c) Interfere with, disrupt, impair, or impose an unreasonable burden on the normal operation of the services or underlying infrastructure. (d) Submit, upload, disseminate, or store false, deceptive, malicious, or harmful data or content, including malware, viruses, trojans, or similar threats. (e) Infringe upon the intellectual property rights, privacy rights, personal data rights, or any other rights of third parties. (f) Utilize the services for commercial purposes, competitive intelligence, or data scraping/harvesting without the prior written authorization of the Service Provider. (g) Create multiple accounts in order to circumvent limitations or policies of the Service Provider.

7. Sharing Pet Data with Veterinarians and Care Helpers

Pawjai provides features enabling the User to share pet data with third parties via temporary shareable links, as follows: (a) Vet Share: The User may generate a link to share a pet health summary (symptoms, medications, veterinary visit history, latest weight) with a veterinarian. The link shall be valid for seven (7) days from the date of generation. Recipients may access the shared data without identity verification (unauthenticated access) for practical convenience. (b) Helper Share: The User may generate a link for pet care helpers (e.g., family members, pet sitters, temporary caregivers). The link shall be valid for seven (7) days. Helpers may view basic pet information and create activity logs (e.g., feeding, medication, symptoms) without identity verification. The User acknowledges, accepts, and agrees that: (1) The User shall be solely and exclusively responsible for the management, distribution, and control of share links, including the determination of which persons should receive such links. (2) Share links do not verify the identity of the recipient. Any person in possession of the link may access the data for the duration of the link's validity. (3) The Service Provider records only the number of times the link has been viewed (view count) and the time of the most recent view. The Service Provider does not record the identity of the viewer. (4) Data recorded by care helpers shall be stored in the Pawjai system under the label designated by the User. The Service Provider does not verify the accuracy, reliability, or identity of the care helper. (5) The Service Provider expressly disclaims all liability for any damages, losses, or consequences arising from: inadvertent dissemination of share links, access by unauthorized persons, inaccurate or harmful data recorded by care helpers, or medical decisions made in reliance on data shared through this feature.

8. Activity Logging and Pet Weight Tracking

Pawjai provides tools for recording activities and tracking pet health data, as follows: (a) Activity Logging: The User may record daily activities, symptoms, medications, veterinary visits, vaccinations, grooming, and other pet activities, together with supplementary data such as energy/mood ratings (vibe rating), notes, photographs, and additional metadata. (b) Weight Tracking: The User may record pet weight for long-term trend monitoring. Weight data is stored in kilograms and displayed in the User's preferred unit. Conditions of Use: (1) Data recorded through these features is user-submitted. The Service Provider does not verify, validate, or endorse the accuracy, completeness, or medical value of any recorded data. (2) Activity logs and weight records, including any data derived therefrom, are intended solely as personal record-keeping and tracking tools and shall not be construed as medical records or prescriptions under any circumstances. (3) The User shall be solely responsible for all decisions made in reliance on recorded data, including but not limited to medication administration or pet care and treatment. (4) Data storage limitations may vary by subscription plan, as specified in the application. (5) Deleted data shall enter a soft-delete state and shall be permanently deleted in accordance with the data retention policy set forth in the Privacy Policy.

9. Notifications and Reminders

Pawjai provides a notification and reminder system, as follows: (a) User-Created Reminders: The User may create reminders for medication administration, veterinary appointments, grooming, or other activities. Reminders may be set as one-time or recurring (daily, weekly, monthly) and may be associated with one or multiple pets. (b) System Notifications: The Service Provider may send service-related notifications, such as subscription status, security alerts, or pet care recommendations. The User acknowledges and agrees that: (1) Reminders are provided solely as a convenience tool. The Service Provider does not warrant that notifications will be delivered on time, without interruption, or without error. Notification delivery is dependent upon multiple factors beyond the reasonable control of the Service Provider, including but not limited to internet connectivity, device settings, operating system configurations, and third-party notification delivery services (such as Apple Push Notification Service and Firebase Cloud Messaging). (2) The Service Provider expressly and categorically disclaims all liability for any damages, consequences, or losses arising from notifications that are not delivered, delivered late, delivered in duplicate, or delivered in error, including but not limited to missed veterinary appointments, failure to administer medication, failure to receive emergency alerts, or any other adverse effects on the health or welfare of the User's pet. (3) The User shall be solely and exclusively responsible for managing their pet care schedules, medication administration, and veterinary appointments, and shall not rely on the Pawjai notification system as the sole means of managing such matters. (4) Reminder data (such as medication names, schedules, and notes) shall be stored in accordance with the Privacy Policy.

10. Mobile Applications and App Stores

Pawjai may provide the service through its website, iOS application, Android application, or other channels. Downloading, installing, purchasing, or using the application through the Apple App Store, Google Play, or another platform may also be subject to that platform's additional terms and policies. If platform rules concerning downloads, app licensing, billing, renewal, cancellation, or refunds conflict with these Terms, the platform rules control only the relevant platform transaction or use. The remainder of the relationship between the user and Pawjai remains governed by these Terms and applicable law. The app-store provider does not provide Pawjai's pet-related information, AI features, or other Pawjai services and is not responsible for Pawjai's content, advice, operation, or support, except to the extent required under the platform's own terms or applicable law. Pawjai may release updates or modifications to add features, correct errors, maintain security, or comply with operating-system, platform, and legal requirements. Users may need to install a supported application or operating-system version to use certain features. Pawjai does not guarantee that the service will remain compatible with every device, operating system, or third-party software.

11. Prices, Service Plans, Renewals, and Refunds

Pawjai may offer free services, one-time purchases, or subscriptions. The features, price, service period, billing frequency, taxes, and conditions shown at checkout when the user confirms a transaction will govern that purchase. Prices may vary by country, currency, taxes, exchange rates, payment channel, promotion, and platform pricing. Pawjai may introduce, discontinue, or change service plans, features, benefits, fees, and prices for legitimate business reasons, including changes in service features, operating costs, taxes, exchange rates, legal requirements, or third-party platform charges. A price change will not retroactively affect a service period already paid for. For an automatically renewing subscription, a new price will take effect no earlier than the applicable renewal after the notice, consent, and cancellation opportunity required by law and the relevant app-store rules. Where affirmative consent is required, the subscription may expire if the user does not consent. Users may cancel before the new price takes effect. Unless stated otherwise, a subscription renews for the billing period selected by the user until cancelled. A purchase made through an app store must be managed or cancelled through the app-store account used for that purchase. Uninstalling the application, stopping use of the service, or requesting deletion of a Pawjai account does not automatically cancel app-store billing or a subscription. Cancellation generally takes effect at the end of the paid period unless the platform, applicable law, or specific offer provides otherwise. Refund eligibility and requests are governed by the applicable app store, payment provider, and mandatory consumer-protection law.

12. Cancellation, Suspension, and Termination

You may cancel your account through an available in-service method or by contacting support@pawjai.co. You may request an export within thirty (30) days after cancellation. After that period Pawjai has no duty to retain or provide the data unless applicable law requires otherwise. Pawjai may suspend access immediately where it reasonably believes activity involves fraud, crime, a system threat, infringement of another person's rights, or a risk of serious harm, and will explain the reason where reasonable and lawful. For an ordinary remediable breach, Pawjai will ordinarily provide notice and a reasonable opportunity to cure unless doing so would create risk or conflict with law. Termination does not affect accrued rights, obligations, debts, or claims. Provisions concerning intellectual property, liability, third-party claims, disputes, and general legal terms survive to the extent their nature requires.

13. Warranties and Limitation of Liability

Pawjai will use reasonable care and efforts in providing the service, but the service may be interrupted, changed, or contain errors and is provided on an as-is and as-available basis, subject to warranties and rights that applicable law makes mandatory. To the maximum extent permitted by law, Pawjai is not liable for indirect, special, incidental, or consequential loss, loss of profit, business opportunity, or data that is not a direct and reasonably foreseeable consequence of Pawjai's breach. Pawjai's aggregate liability relating to the service will not exceed the greater of (a) fees actually paid by the user during the twelve (12) months before the event giving rise to liability or (b) THB 1,000. These limitations do not apply to fraud, willful misconduct or gross negligence, non-excludable personal-data obligations, death or personal injury where limitation is prohibited, mandatory consumer rights, or any other liability that cannot lawfully be excluded. If any limitation is unenforceable, it will apply only to the maximum extent permitted without invalidating the remainder.

14. Dispute Resolution

In the event of any dispute, controversy, or claim arising out of, relating to, or in connection with these Terms, or the breach, termination, or validity thereof, both parties agree to use good-faith efforts to resolve such dispute through negotiation or mediation for a period of no less than thirty (30) days from the date on which one party delivers written notice of the dispute to the other party, prior to commencing any court proceedings or other dispute resolution mechanisms. The User may file a written complaint at support@pawjai.co, and the Service Provider shall respond within fifteen (15) business days from the date of receipt of said complaint.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to conflict of laws principles. Any dispute that cannot be resolved through negotiation or mediation pursuant to Section 10 hereof shall be subject to the exclusive jurisdiction of the competent courts of the Kingdom of Thailand.

16. User Responsibility for Third-Party Claims

Subject to applicable law, you are responsible for reasonable third-party claims and costs directly caused by (a) content you submitted without authority, (b) unlawful use of the service or intentional infringement of another person's rights, or (c) your material breach of these Terms, in each case only to the extent caused by your conduct. Pawjai will provide prompt notice of a claim, a reasonable opportunity for you to provide information or participate in the defense, and will not agree to a settlement imposing non-monetary obligations on you without your consent. This responsibility does not extend to the portion of a claim caused by Pawjai's willful misconduct, gross negligence, or violation of law.

17. General Provisions

Severability: Should any provision or part thereof of these Terms be adjudicated by a court of competent jurisdiction to be void, invalid, or unenforceable, such provision shall be severed from these Terms or modified to the minimum extent necessary to render it enforceable, without prejudice to the validity or enforceability of the remaining provisions. Language and Interpretation: These Terms are prepared in the Thai and English languages. In the event of any conflict, ambiguity, or discrepancy in interpretation between the two versions, the Thai version shall prevail in all cases. Entire Agreement: These Terms, together with the Privacy Policy, Marketing Consent, and any documents incorporated by reference herein, constitute the entire agreement between the parties with respect to the subject matter hereof, and supersede all prior agreements, negotiations, understandings, or proposals relating to the same subject matter, whether written or oral. No Waiver: The failure of the Service Provider to exercise or delay in exercising any right, power, or remedy under these Terms shall not constitute a waiver of such right, power, or remedy, and the single or partial exercise thereof shall not preclude any other or further exercise of any other right, power, or remedy. Force Majeure: The Service Provider shall not be liable for any delay or failure to perform its obligations under these Terms due to force majeure, acts of God, war, civil unrest, epidemics or pandemics, changes in law, governmental orders, internet infrastructure failures, or any other events beyond the reasonable control of the Service Provider.
